$5.1 Million Verdict in Aerojet Case
Stephanie Foster learned in 1999 that she had mesothelioma, the most serious
of all asbestos-related diseases caused by fibers lodged in the lungs.
The Missouri woman died from the condition at the age of 42.
Stephanie was exposed to asbestos as a toddler. Her father,
Robert Foster Jr., had worked for an Aerojet contractor 40 years before,
machining asbestos on a lathe. "He would come home from work and
grab his little girl and give her a hug -- with no idea that he carried
asbestos on his clothes," said Ted Gianaris, a lawyer for Stephanie's
family.
The defendant, Aerojet-General Corporation, a Rancho Cordova,
California, maker of rocket and missile motors for the military, had denied
ever using asbestos. "We repeatedly asked Aerojet about the use of
asbestos and they said no, no, no," said attorney Randall Bono. "But
we found evidence otherwise."
The defendant was sanctioned and defense lawyers were barred from presenting
evidence that the company had never used asbestos in its products. The
judge also directed the jury to find that the plaintiff was exposed as
a child and that the company knew the material was hazardous at the time.
Stephanie's family was awarded $5.1 million by the St. Louis jury.
$250 Million Verdict Against U.S. Steel
U.S. Steel Corp., North America's
biggest producer of raw steel, was ordered by a jury to pay $250 million
to a former employee with mesothelioma. The verdict, delivered by a Madison
County, Ill., jury, includes $50 million in compensatory and $200
million in punitive payments.
The award is one of the largest to a single plaintiff
in an asbestos case in the U.S. Roby Whittington, 70, was diagnosed in
2001 with mesothelioma, which he said he was exposed to while working
at U.S. Steel's Gary Works plant in Gary, Ind., from 1950 to 1981. The
company used the fire retardant in insulation. The cancer, in the lining
of his lung, is terminal said John Simmons, one of the attorneys representing
Whittington.
$34.1 Million Verdict for a Missouri
Man Against Shell Oil Company
Our client was exposed to asbestos when he worked
for Shell’s Wood River, Illinois Refinery from 1956 – 1966.
He was diagnosed with Mesothelioma in 1998. The verdict consisted of $25
million in punitive damages and $9.1 million in compensatory damages.
$9.7 Million Mesothelioma Settlement
This settlement was won for a Missouri man exposed
to asbestos when he worked as a warehouseman, insulator helper and warehouse
manager in Illinois and Missouri from the mid 1960s to the mid 1970s.
He was diagnosed on March 6, 2000.
